Sarah Berger Richardson es
 t candidate au doctorat à la Faculté de droit de l’Université McGill.
  Sa recherche porte sur la relation entre la science et l’éthique dans 
 la régulation de la salubrité des aliments. Sarah est membre du Barreau 
 du Haut-Canada et a obtenu un LL.M de l’Université de Tel Aviv où elle
  a été chercheuse au Manna Centre in Food Safety and Security. Auparavan
 t\, elle a été  auxiliaire à la Cour suprême d’Israël et à la Com
 mission de révision agricole du Canada.
Sarah Berger Richardson is a doct
 oral candidate in the Faculty of Law at McGill University. Her research fo
 cuses on the relationship between science and ethics in food law and polic
 y. Sarah is a member of the Law Society of Upper Canada and completed her 
 LL.M at Tel Aviv University\, where she was a research fellow at the Manna
  Center in Food Safety and Security. Previously\, she was a law clerk at t
 he Supreme Court of Israel and the Canada Agricultural Review Tribunal.

 ÉSUMÉ / RESUME :
Au cours des récentes années\, de nouveaux règlemen
 ts sur la salubrité des aliments ont été adoptés pour renforcer la con
 fiance des consommateurs envers la sécurité de l’approvisionnement ali
 mentaire canadien. Ces règlements s’appuient sur des connaissances scie
 ntifiques et des expertises afin de justifier un régime de gouvernance te
 chnocratique qui obscurcit les débats éthiques sur ce qui constitue une 
 bonne alimentation.  Le droit et la politique alimentaire ne peuvent pas 
 toutefois être neutres en termes de valeurs. Les déterminations du risqu
 e acceptable impliquent nécessairement des jugements de valeur. Le droit 
 et la politique alimentaire sont donc caractérisés par des conflits entr
 e des biens rivaux. L’éthique de la vertu peut nous guider à travers c
 ette confrontation d’une manière que la gouvernance technocratique ne l
 e peut pas.
In recent years\, new food safety regulations have been introd
 uced to strengthen consumer confidence in Canada’s food supply. These re
 gulations draw on scientific and expert knowledge to justify a mode of tec
 hnocratic governance that obscures ethical debates about what constitutes 
 good food. Food law and policy\, however\, is not a value-neutral exercise
 . Determinations of acceptable levels of risk involve value judgments. Foo
 d law and policy is characterized by conflict between rival goods.Virtue e
 thics can guide us through this confrontation in ways that technocratic go
 vernance cannot.
