SUMMARY:Reconsidering the Roots of the Living Tree: An Outsider's Suggestio
n for Reimagining Canadian Judicial Federalism
DESCRIPTION:Conférenciers :
Stephen Ross\, Lewis H. Vovakis Distinguishe
d Faculty ScholarProfessor of LawDirector\, Penn State Institute for Spor
ts Law\, Policy\, and ResearchRichard Janda\, Associate Professor
Associ
ate Member\, McGill School of EnvironmentThe talk examines the living tree
of Canadian federalism\, questioning how one can determine the natural li
mits without an examination of the roots. I find them in Hector Langevin
’s argument during Confederation debates that federalism assigned matter
s dividing Canadians demographically to the provinces and those dividing t
hem ideologically to Ottawa. The talk then critiques the PC and SCC’s a
historical approach\, which is difficult to differentiate from unbridled j
udicial discretion\, and applies Langevin’s distinction to modern issues
. The result would expand the scope of s. 91(2) but limit the paramountcy
doctrine to increase provincial legislative authority over related matters
  under the double aspect doctrine.
Cette formation a fait l'objet d'une
demande de reconnaissance de auprès du Barreau du Québec (1h30)
